The Site is operated by The Reluctant Trading Experiment LLC as Reluctant Wholesale. You agree that you are liable for purchases made through your ReluctantWholesale.com account and assume responsibility for taking reasonable action to safeguard your account information to prevent unauthorized purchases. You further agree to notify The Reluctant Trading Experiment promptly should you become aware of any actual or potential compromise of your account information so that The Reluctant Trading Experiment may take appropriate actions to safeguard its legal interests.

CHANGES AND TYPOGRAPHICAL ERRORS

The Reluctant Trading Experiment reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Site following the posting of any changes to this Agreement constitutes acceptance of those changes. The Reluctant Trading Experiment may also, in the future, offer new services and/or features through the Site. Such new features and/or services shall be subject to the terms and conditions of this Agreement.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, The Reluctant Trading Experiment shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. The Reluctant Trading Experiment shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and payment charged. If payment has already been charged for the purchase and the order is canceled, The Reluctant Trading Experiment shall issue a credit in the amount of the charge.

TERMINATION

The Reluctant Trading Experiment may terminate your access to all or any part of the Site at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your ReluctantWholesale.com account, if you have one, you may simply discontinue using the Site. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

DISCLAIMER OF WARRANTIES

The Site is provided “as is.” The Reluctant Trading Experiment and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither The Reluctant Trading Experiment nor its suppliers or licensors makes any warranty that the Site will be error-free or that access thereto will be continuous or uninterrupted.

LIMITATION OF LIABILITY

In no event will The Reluctant Trading Experiment, or its suppliers or licensors, be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement of substitute products or services; or (iii) any amounts that exceed the fees paid by you to The Reluctant Trading Experiment. The Reluctant Trading Experiment shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

INDEMNIFICATION

You agree to indemnify and hold harmless The Reluctant Trading Experiment, its contractors and its licensors, and their respective directors, officers, employees and agents, from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Site, including but not limited to your violation of this Agreement.

MISCELLANEOUS

This Agreement constitutes the entire agreement between The Reluctant Trading Experiment and you concerning the subject matter hereof, and may only be modified by a written amendment signed by an authorized executive of The Reluctant Trading Experiment or by the posting by The Reluctant Trading Experiment of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement and any access to or use of the Site will be governed by the laws of the State of Illinois, U.S.A., excluding its conflict-of-law provisions, and the proper venue for any disputes arising out of or relating to the same will be the state and federal courts located in Lake County, Illinois.

ELECTRONIC COMMUNICATIONS

You acknowledge that these Terms of Service are a valid and binding agreement. To the fullest extent permitted by law, you agree that these Terms of Service and any other documentation, agreements, notices or communications between you and The Reluctant Trading Experiment may be provided to you electronically. Please print a copy of such documentation, agreements, notices or communications for your reference.

All information contained on this Site is property of The Reluctant Trading Experiment LLC unless otherwise noted. Any reproduction without express written consent of The Reluctant Trading Experiment is prohibited.
